I'm trying to handle this situation the best possible way. Without the use of a lawyer. I gave the seller x dollars in earnest. The deal did not work out. I am thinking that the monies should be returned to me. While the seller thinks the opposite. The catch in the whole deal is that my spouse did sign the last counter offer and return it to the sellers agent, I was at work and did not sign. Therefore my question is, is this a legal binding contract, if the mortgage is is jointly applied for, but the contract is not jointly signed and neither of the buyers party has power of attorney to sign for the other. Please tell me who is right.

Also I live in Georgia if it makes any difference. Thanks.

Don't know about Georgia specifics, but I don't think it is a binding agreement without all sigs. Unless of course the contract states otherwise.

Don't you have contingencies, such as for inspections and loan approval? And what does YOUR agent say?
