Trying to find out what happens when sellers of house, after contract ratified, all signed, done deal, etc. want to extend settlement date and when refused threaten to not appear at the settlement??? This is happening in state of West Virginia and so far no help from Consumer Affairs or Real Estate Board there as to what repercussions on sellers?? Thank you for any help given.

| | Saturday, February 19, 2000 - 06:49 pm HELLO! WE FILED CHAPTER 7 BANKRUPTCY AND WE HAVE BEEN LIVING IN THE HOUSE FOR OVER 3 MONTHS NOW. THE QUESTION I HAVE IS HOW LONG DUE YOU THINK WE HAVE BEFORE WE ARE EVICTED? AND DO THEY TELL YOU IF HAVE A CERTAIN AMOUNT OF TIME TO LEAVE BEFORE THEY PUT A BOLT OF THE DOOR, CHANGE THE LOCKS,AND PLACE A NOTICE ON THE DOOR. IF IN FACT THAT'S THE WAY THEY DO THINGS. WE HAVE BEEN TRYING TO SAVE MONEY FOR THE MOVE THAT'S WHY WE HAVE'T MOVED OUT YET. WHEN PUT SO MUCH MONEY INTO THIS HOUSE SINCE WE BOUGHT IT. WE REPLACED THE WINDOWS, NEW CARPET THRU OUT THE ENTIRE HOUSE, A NEW BATH ROOM, A PERGO FLOOR, NEW ROOF, AND DOORS. SINCE THEN THE WALLS HAVE DEVELOPED VERY NOTICABLE CRACKS, THE INSULATION IS BAD. IN THE SUMMER IT IS VERY HARD TO BE COMFORTABLE AND IN THE WINTER IT IS SO COLD INSIDE. WE ALSO HAVE SOME TYPE OF BACTERIA THAT HAS FORMED ON THE WALLS. THE PLUMBING IS TERRIBLE, AND I HAVE A HUGE CRACK IN MY DRIVEWAY AND GARAGE FLOOR PROBABLY MY FOUNDATION. WE BOUGHT A HOUSE THAT'S LEMON. IT LOOKED GOOD ON THE OUTSIDE AND WE THOUGHT WE WOULD BE HAPPY. WE COULD ONLY PAY THE MORTGAGE,BUT WITH ALL OF THE REPAIRS IT IS IMPOSSIBLE . GIVE ME SOME INPUT PLEASE. THANKS, Jeff

| | Sunday, February 20, 2000 - 04:46 am I'm Sorry. I'm new at this. Here's the deal. My mortgage company has filed a Notice of Default. I previously filed Chapter 7 and was informed by my attorney that if and when I was unable to handle the mortgage, I could let the house go and the bankruptcy would absorb the debt. How long do I have after a Notice of Default has been filed to vacate the home? Will I be notified of any other impending actions? I found out about the Notice of Default being filed as a result of an attorney soliciting possible business. In the letter the attorney indicated that my mortgage company had filed a Notice of Default with the County Recorder's Office . Thank you for your input.
