Top (Top) | Thursday, February 22, 2001 - 10:42 am Year 1999, I applied for the Credit Card from BankFirst, NA (https://www.actionbankcard.com/platinum/default.asp) After that I realized about the fees I immediately called BankFirst and canceled my application. I have never received the Credit Card or even a single letter from BankFirst. I recently received my credit report from 3 Credit Report Agencies (Experian, TransUnion and Equifax). The credit reports showed an item from BankFirst. My question is: Does BankFirst have the right to report on my credit report, as I have no account with BankFirst, nor am I their customer, nor have I ever received or used their service? |
Christine Baker (Admin) | Thursday, February 22, 2001 - 11:43 am By "an item" do you mean an account or an inquiry? If it's an account, what are they reporting? |
Top (Top) | Friday, February 23, 2001 - 03:55 am Thanks Christine, They are reporting an account, also have the 30 days late payment on the account. I don't mind about inquiry but It's shown the account with 7 months payment history. I've never received the credit card from them because I canceled the application right away after I applied for it. I did call BankFirst, They refused to remove the account from my credit report. They said they will only removed late payment. And will close the account as consumer's request. As I understand open the account and close in short period of time, It makes my credit report look bad?? Thanks in advance. |
Christine Baker (Admin) | Friday, February 23, 2001 - 09:25 am I can't say how it makes your credit report look because I haven't seen it. Having the account without the late payment may not hurt you if you don't have many other (new) accounts. Having a zero balance could help your credit scores if the limit is reported, but there are many factors and it depends on all the accounts reported on EACH report. This is very strange. Since you never paid any fees, why not have them mail you the card, and keep it open? You don't have to use it. If they'll then charge fees, or you already have a lot of accounts, send them ONE fax demanding they remove the account entirely, then sue (possibly in Small Claims) if they don't do it. |
Shylock (Shylock) | Friday, February 23, 2001 - 10:01 am The point is that in order to issue him a credit line they want for him to pay certain fees. He is not amenable to paying all those fees in order to have credit. |
Christine Baker (Admin) | Friday, February 23, 2001 - 10:35 am Then they have to remove the account, if that's what he wants. |
Top (Top) | Sunday, February 25, 2001 - 04:58 am Thanks Shylock and Christine, I don't want their credit card because of the fees. That's why I canceled the application right away. On my credit report I saw they gave me credit line $300.00 and they keep it current about 7 months then the account has been closed by consumer's request. I did send them fax demanding to remove the account from my credit report. But they response that they have the right to report. I just don't get it, I never received the card or even use their services. I contacted them so many times (4 times) and got the same answer that they will not remove. |
Shylock (Shylock) | Sunday, February 25, 2001 - 07:38 am The entry is deceptive, but it's not that big of a deal as long as it contains no negatives. |
Christine Baker (Admin) | Sunday, February 25, 2001 - 11:59 am Just for the record, they do NOT have the RIGHT to report the account. It's probably not worth going to court over, but the FCRA states that creditors must report accurate info. |
Top (Top) | Monday, February 26, 2001 - 02:55 pm Hi, After I sent BankFirst the Fax demanding them to remove the account from my credit report. Here is their response : "When you were approved for a credit card, a tradeline was established on your credit bureau. As your intention was to apply for credit, this tradeline cannot be removed" How's that? |
Christine Baker (Admin) | Monday, February 26, 2001 - 03:46 pm Do you have proof of your cancellation? If not, I'd ask why they did not send a card and inform you that they opened an account. |
Top (Top) | Wednesday, February 28, 2001 - 05:06 am Hi, I don't have proof of cancellation. Because I called them to cancel an application. Never ever received a single letter from them. I also asked if BankFirst report an account why didn't you send me the card. They said because I canceled it. It doesn't make any sense. I am going to file the complaint to FTC and keep you posted. Thanks all for your help. |
