Several phone inquiries with Equifax about how to notify Equifax of FCRA violations resulted in the phone reps providing me with the FTC's phone number. When I insisted on an EQUIFAX address and fax #, they finally gave me the Equifax Consumer Relations # 770-375-3114. After over 1/2 hour on hold I gave up.

So I'm faxing my complaint to the fax numbers I found at equifax.com:

I hereby request that Equifax investigate the Inovision FCRA violations and close their credit reporting account:

Inovision is reporting old charged off accounts as currently open and with recent late payments. Fair Isaac scores for people with NO OTHER delinquencies are in the 500's, causing extensive damages including mortgage denials. Inovision REFUSED to correct their reporting.

If Equifax refuses to investigate these FCRA violations, I hope that the Inovision victims will sue Equifax as partners in crime.

I will certainly do anything I can to assist attorneys and consumers with law suits against Inovision and their supporters.

This is an account from a former utility company in PA 12/95 we moved to VA in 1/96.

Update:

After about 50 hours of faxing, holding and discussing this account and the reporting in detail with numerous managers at Equifax and supervisors at Inovision and Joel Lewis, the president of Inovision:

Supposedly this is Fair Isaac's fault.

Joel Lewis, president Inovision:

He has his credit reporting reviewed by his attorneys every few months and they comply with the FCRA.

When I disagreed and mentioned law suits, I got screamed at:

All you had to do was pay your bill! I'm really looking forward to your suing us! Our attorneys will countersue immediately and you better have VERY deep pockets because we will tie you up in court for years! We have a policy of countersuing all these people who think they can get away with suing us for minor infractions and we win EVERY case! I'm sick and tired of you people not paying your bills! ....

Since he was so much looking forward to countersuing me, I asked if he would help me out a little by providing their legal address. He responded "I'm not going to give you anything."

I asked for some details on those "frivolous" suits and he also refused.

I called him back a little later and asked how they would report the account if it was paid in full:

All of a sudden we were partners. They take credit cards, Western Union, he would personally fax to me or to mortgage companies the proof of payment.

But what about those LATE payments? How will the account be reported?

Mr. Lewis claimed that Inovision isn't reporting ANY late payments, Equifax is calculating those.

I spent some time on this, but he insisted that it's Equifax's fault. "Equifax needs to be punished ...." I'm not kidding, that's what he said.

So, back to calling Equifax again:

Of course Equifax does NOT add anything to the credit reporting. We all know that.

ONLY Inovision can have those late payments removed.

During our discussion, Sean, manager of Team D told me that the collection was reported as an "internal" collection which I thought might explain why it is OPEN.

He told me to fax my authorization again today and request reinvestigation, because Inovision is NOT the original creditor. They purchased the charged off account from the utility company a couple of years ago.

He also confirmed that if the account was paid, it would NOT change the 120+ days late 3/2001 notation.

So today I faxed the authorization again, waited the hour it takes for them to talk to me after the receipt, and eventually I spoke with Sean again. He told me that he discussed this account with their legal department and that it IS reported correctly.

AND, he informed me that the Power of Attorney now needs to be notarized.

I insisted on getting this in writing, and he referred me to their Consumer Relations # 770-375-3114. Spent an hour on hold and talking to various people.

Result: The manager was WRONG yesterday when he thought that the account was reported as internal collection.

Collection accounts may be reported as OPEN accounts in the TRADE LINE section with CURRENT late payments as long as the date of last activity is reported correctly.

How collection agencies report depends on the type of account they purchase from Equifax.

And no, not a chance of getting anything in writing. That's why I've been audio recording my calls. I'm so sick of the lies.

Highlights of my call with Lanette, the last person I spoke with at the Equifax 770 #:

Question:

WHY is this collection NOT reported in the section titled "Collections?"

Answer: There is no law requiring collections to be listed in that section.

Question:

Why can this account be reported as OPEN?

Answer: Don't they still owe $246?

Follow up:

I did NOT object to reporting the outstanding balance, but the account has been closed for over 5 years and is NOT aging, just look at the 571 credit score.

Answer: They haven't paid their bill ....

According to Fair Isaac, PAYING a collection will NOT raise the scores.

Something is really screwed up.

From my e-mail to Fair Isaac:

"I've spent about 50 hours in the last 8 days getting the finger pointing from collection agency Inovision and Equifax, and finally everybody is pointing at Fair Isaac.

My client's credit report is FLAWLESS, except for a 12/95 $246 utility collection. While the account is reported as collection, it is reported with the tradelines as currently past due and 120+ days late. The date of last activity is 12/95.

Quote from my fax to Inovision and FTC complaint:

""I found that your INCORRECT reporting of the PECO Energy account is SERIOUSLY lowering his credit score.

"Credit score: 571
Source of score: Equifax (BEACON®)
Reason codes: 39 14 13 34

First Reason Code: 39 Your first reason code is 39, “Serious delinquency”. This is the single most important factor affecting your score. This reason appears when your credit report shows one or more serious delinquencies on your credit accounts. Studies reveal that consumers with previous late payments are much more likely to pay late in the future. There is no “quick” fix to improve the score if the serious delinquency indicated on your credit report is valid. However, as these age and fall off the credit report (credit account delinquencies stay on your report for up to seven years), their impact on the score will gradually decrease."

This above statement is a direct quote from Fair Isaac Company.

....."

It doesn't look to me like the impact is gradually decreasing at all.

The collection is currently unpaid, the statute of limitations expired over a year ago, but even if my clients pay the account, the scores won't increase. At least that's what you said last time we went over this.

Just got off the phone with Equifax, Lanette, 770-375-3114. She informed me that the account is reported correctly.

So, does Fair Issac think my client deserves that score of 571?

ONE minor collection ruins someone's chances for a mortgage for 7 years?"

I hope we'll find out whether EVERYBODY with a very small payment problem has to file for bankruptcy to protect their credit scores.

Update: I left another message for Barry at Fair Isaac, and unfortunately I was on the phone when he called me.

Essentially he said that there must be something else more RECENT, within a couple of years. A 12/95 collection would not bring the score down that low. "... something recent is happening ..." or the collection is reported as more recent.

Well, ** I ** think it's that current delinquency reported by Inovision. I called Barry right back and of course got HIS VM again. I've requested HIS fax number because I'm not going to fax a credit report to the general Fair Isaac fax.

Barry also mentioned that he is EXTREMELY busy and looks at things in the order received. I'd sure like to get the entire report to him so HE can tell me what's going on.

And of course he mentioned that he can't change scores.

I'll keep trying ...
