Hi,

First - I have disputed my bk with Experian due to the fact that it is listed as a joint filing instead of an individual filing. I filed bk in Dec. 98 and it was discharged in March 99. A few weeks ago it came back verified. I disputed again and asked for validation. Today, I get my report and in the consumer statement area it says "Disputed by consumer", and the filing status still states joint. Any ideas on how to proceed? I never asked for the comments to my file only that they report the bk correctly or delete it completely. Please give me ideas on what to do next.

Second - I disputed a paid judgment on my credit report. The updated reported came back and shows in the resolution area "released". What does this mean? Any ideas on how to proceed?

Third - I have items on my reports that were from 1994 and 1995. Can I write to them and dispute the items as obsolete? All of the items I am referring to are supposedly due to fall off within the next six months.

Experian also did that with a dispute of mine. When I asked about it I was told that NY state required them to note it. They did remove it at my request.

I don't have an answer, but when I looked up in my county's database and didn't see my judgement in there any more I disputed mine and am waiting to see how it turns out.

Dispute them based on the dates. The last date of activity was '93. Can't hurt.

Continue to dispute the items until the inaccurate portions are gone. Make up one letter that clearly explains the problem and change the date on it. Send it in every 2-3 months until the 'joint filing' status gets updated.

It took me four tries to get a credit limit added and I had it in writing from the credit card issuer what the credit limit was. These people are lazy, rushed or both.

Hi,

I contacted TransUnion and the rep told me that released means it has been deleted.

I also have some good news. I have a old lien judgment that was initiated around the time of my bk. However, it was still showing open on my credit reports. I contacted the agency and was told by a rep that they received the BK discharge but had forgotten to file a motion to vacate their judgment. The rep told me she would forward me a copy of the motion they are filing and once it is finalized in the court I should send it to the credit reporting agencies to have them remove it from my report. I was elated because I thought I still owed them this money. Needless to say, she got no arguments out of me about filing the motion to vacate. I can't wait for those papers. I know it will improve my credit score.

Hi Again,

Also, I have been fighting with this attorney who filed a judgment with myself and my husband erroneously over a hospital bill. I had to have someone in the legal department of our medical insurance company write a letter stating it was illegal for them to seek a judgment for payment since we were covered by them. To make a long story short, the attorney immediately filed a warrant to satisfy judgment, however, it was still on our credit reports. I contacted the attorney and told him he would have to file a motion to vacate since we should never have been sued in the first place. He even had the nerve to ask me if I would pay for his legal fees. I told him no, but I would sue him if he did not take the legal step to amend the situation. This is a blatant violation of our rights. I have so much proof against him,
I'm sure I'll be getting the information I need very soon to clear this item off of our reports.

I'll have to say, had I not acquired the stregnth and knowledge from this board and others, I would have just accepted that this item would appear for the next 7 years on our reports.

I'm glad you're having success, make sure that judgment really does get deleted. With your bk discharge being 2 years old now you should be on your way to good credit.

I might add that it inappropriate for him to ask you to pay his attorney's fees. Not outright illegal, but more of a breach of contract. Insurance carriers have negotiated rates with health care providers. For them to attempt to assess collection fees, attorney's fees or any other fee in excess of the negotiated rate could result in cancellation of their preferred provider status and a lawsuit from the health carrier.

Update -

I recently sent in proof of the agency submitting a motion to vacate a judgment. I am so glad. I also had some luck earlier this month with a few items being deleted off of my reports. In addition, most of my accounts will have aged the 2 years over the next few months. My old student loans is due to fall off my report in May and the other in June. I am getting very excited.

I am still waiting on the other attorney to file the motion to vacate judgment. Although, he did say he would file, I got the impression that maybe he would not since there would not be someone to pay his attorney fees. I am giving him one more week and if I don't receive paperwork I am going to go down and request a hearing with the judge on the case. Basically, I have all the proof I need to sue him in small claims.

In March I ordered my score from Equifax and it was 552. Since then I will have the two judgments deleted as well as the two default student loans removed. Any ideas on what my score will be. I don't plan on ordering my score again until late fall of 2001 since most of my accounts will have aged the two years and the two public records and defaulted student loans will not be there.
