I wanted to add this posting to the old postings on Mellon Mortgage but am unable to. I am DELIGHTED to hear that I'm not the only person getting screwed by Mellon Mortgage.

I sold my last home 4 months ago (with a Mellon Mortgage). Now I am desperately trying to buy a new house. Problem is that Mellon reported two late payments a year ago to the credit bureaus. Well I dug up cancelled checks to prove them wrong and entered into a dispute with them. Thanks to my efforts to dispute those two late payments, now Mellon is claiming that I was late every single month for the last two years of my mortgage and that they NEVER received 7 months of payments all together. So off goes more cancelled checks to prove them wrong again, more letters and faxes that they won't respond too. BUT here comes the rub.

I have 10 days left to get a new mortgage or I lose the house I have a contract on. The new lender will not give me a mortgage until I clean up this mess with Mellon. Mellon won't even respond back. They say they sent a letter "acknowledging" receipt of the documentation I've sent them, but there is no letter in sight. Since my mortgage with them is paid off, they have no incentive to correct their records, and from the other postings on them, I don't see much hope there anyway. I'm stuck between two rocks.

To top off the situation, the current rental I'm staying at was perfectly fine with my 150lb dog when I moved in (he's been quiet as a mouse and extremely well behaved here) but has since changed their pet policies. If I don't get this new mortgage (and house), and our short term rental lease expires, my dog and I run every chance of being homeless. The area I live in has a 99% rental occupancy rate, let alone a place that will take my dog.

Help!!!

We are in foleclosure with Mellon Mortgage. They
raised our payments without notifying us, they
misplaced our escrow, taxes weren't paid, never
notified us and foreclosed with 3 days notice.
More details than this. We have an attorney on this now but may be too late. How do we get in
touch via an email address to directly send info
to? We need names of folks for our attorney.
Please respond to me at GodChar@AOL.

I used an automated bill paying service to pay them. My bank statements show every payment went out on time, as they had for 7 years. But then Mellon changed the account to send the money to, and then charged a late fee when one payment was sent to the old account. They subtracted the late fee from the next payment (to the right account), and since what is left over was a "partial payment", called that "late" too. The next payment had both the remaining payment and a new late fee deducted, so it was an even smaller "partial payment". When I got the late notices I called them. The guy said "Oh, I see. Don't worry I'll take care of it." He went on to say I might still get some late notices, but just ignore them.

A few months later they claimed I was a full month behind. Late fees for several months had accumulated even though every payment was on time. I gave up on getting credit for all the late fees I should not have paid, and I just paid a double size payment to try and clear things up, but that didn't work because now the payment had to go to a "special account". By now I was trying to sell the house, and they couldn't find the money I sent in time to clear things up. So I sent in ANOTHER 2 month payment to this different account.

Eventually, they sent back some of the money I paid to clear things up, but not the overcharged late fees. Now the problem is that they've put a major "derogatory" on my otherwise clean credit record.

Everyone who is having a problem with Mellon Mortgage Company should contact the Better Business Bureau of Denver, CO and file a complaint with them.

I pulled their report on Mellon Mortgage Company and it states in part, "In the current 3 year BBB reporting period, the BBB has received numerous complaints regarding this firm generally allege: failure to record mortgage payments, delays in recording mortgage payments, failure to make payments from escrow accounts, delays in paying escrow accounts....."

Someone should sue these guys for tort - intentional infliction of emotional distress; maybe even get punitive damages.

Use the rules of the Fair Credit Reporting Act and document your case, as it happens, on the Internet.

For the audience, it would be interesting watching the developments. For you, it is a chance to resolve the case quickly.

For those interested. Lender's #1 and #2 both turned me down for a mortgage based on the whole Mellon Dispute. The nice thing (is there such a thing?) about Lender #1 is that he put in writing why he was turning me down and put in writing what Mellon Mortgage personnel said to him over the telephone about my past mortgage, which is NOT what they said to ME over the telephone (and in WRITTING) and also is not what they reported to the credit bureaus either. So they deliberately lied to the new lender about their records and got me turned down for a new mortgage. I'm now working with Lender #3.
