My landlord is keeping my security deposity, which is fine; but he also filed an unlawful detainer action against me (without giving me a 3-day notice, as required!) I'm moving out anyway, but will the fact that an unlawful detainer action was FILED against me go on my credit report (or a tenant screening service), even if I never lose the case? The stuff I read says conflicting things: depending on which source you believe 1.)if you are adjudicated the "prevailing party," the fact that an eviction was filed can't be reported by the credit reporting agencies; or 2.) credit reporting agencies can report it, regardless (I live in california). DOES ANYONE HAVE ANY EXPERIENCE WITH THIS? What can I do to keep them from sticking this on my credit report. I'm not even going to get a CHANCE to adjudicate it (though I'd win), because I'm moving out. |
