They did NOT show up for the installation appointment, NEVER contacted me via mail, phone or any other means. REPEATED requests for refund via fax/phone were IGNORED." On 1/29/01, PRIOR to filing the Small Claims complaint, I had faxed: "Ladies/Gentlemen: My order # was N12749163 for phone # 520-649-2923 12/7/98 You charged my account $100, scheduled install for 12/16/98, yet did NOT show up or activate the phone. Total due now is: $100 refund of your charge to my Union Bank account. $40 interest for over 2 years $150 expenses incurred due to your NOT contacting me at all and simply NOT showing up and then refusing to activate the line. $50 my fee for this fax Total: $340 Please note that I did NOT charge for my previous requests for a refund via phone and fax. Unfortunately those request were ignored by you and this is my FINAL demand. Please send $340 to Christine Baker 989 So. Main Street A-150 Cottonwood, AZ 86326 The above address was also my billing address for the order. You are hereby advised that $75 per hour will accrue for any additional time required to get you to pay should I NOT have your check by Feb. 10, 2001 and I **WILL** take legal action and hold you liable for any legal expenses." As usually, Qwest ignored that fax. On 3/14/01 I filed the Small Claims complaint. After Qwest received the filing, Bonnie Convey, claims manager, law department, called me right away. I faxed to Ms. Convey 1) the previously faxed and ignored request for my refund 2) my bank statement - with a big arrow by the debit 3) the original document with the copies of my two picture ID's and all the relevant info which I had faxed to the US West ID Center the first time on December 7, 1998 so they would process my order. Can you believe that Bonnie Convey then called me and requested that I EXPLAIN to her these documents? What gets me more than anything is that Qwest STILL refuses to refund as little as the actual deposit. Ms. Convey offered $120 (principal and interest) ONLY if I agreed to settle for that amount. "When hell freezes over." Mediation is scheduled for this Thursday, unfortunately she got permission to attend by phone. |
