The agent for service is where your law suit has to be MAILED. In this case it is the corporate office and Rocky Lee is the president of ARM computer.

While we're talking about faxing I have to plug faxaway.com again. If you consider suing, I highly recommend you get an INDEPENDENT 3rd party verification of receipt of your fax.

The legal VENUE

Every invoice I have from ARM Computer states:

"In case of legal action, jurisdiction, and venue should be at ARM's place of residence of Santa Clara County, State of California."

I don't know why it says "should be," but ARM requested a change of venue twice after I sued in Arizona small claims court.

I think the reason why Judge Taylor denied that motion is because ARM Computer couldn't produce the invoice with that venue statement. Or he likes Californians even less than me, who knows :)

So, unless you also didn't get an invoice, you're probably better off filing in Santa Clara County, California.

However, you might want to file a small claims suit in another State for the sole purpose of establishing that ARM KNOWS about your problems.

In Arizona it costs me only $20 to let a company know that I'm seriously pissed and ready to take legal action.

And you never know, maybe your judge will give you a break too.
