Jan 96 I co-signed for my boyfriend in Vermont, since then I have moved to Texas and have not heard from him in almost two years. On May 21, 1999 Ford Motor Credit called to inform me that I owe $6000.00 on the default. According to the credit report the last date of activity on this account was 10/98, he had been late on nine payments out of 29, the truck was repossessed in Feb 99 and auctioned off in March 99. Needless to say I was shocked to hear that there was a problem to begin with!!! much less one that had been resolved without my knowledge. After a little searching on the Net I have found that the Vermont Law states that the lendor has to notify the debtor of the time and place of the auction. Unfortunately I have yet to find ANYTHING that pertains specifically to my case where one side of the debtor was never notified or given the chance to redeem the loan and take back the vehicle. Does anyone know the collection process of a creditor, what resources they have to use to contact someone regarding a delinquent account before its too late? Or what my rights as a co-signer are against this debt collection and the damage is has done to my credit report?
