| | Sunday, March 26, 2000 - 11:41 pm I just received this letter and thought I should pass it along. More details are posted on my site. Dear Kristy: I thought you'd like to know that I just filed a lawsuit in Superior Court in Washington against the Big 3 credit reporting agencies. The suit is on behalf of a couple who were denied credit based on credit card accounts on which they were only authorized users, not cardmembers. It is seeking compensatory and punitive damages for willful violation of the Fair Credit Reporting Act and Slander of Credit. If you learn of any other consumers in the same situation, please have them contact me. Thanks. R. Stuart Phillips

| | Thursday, March 30, 2000 - 11:41 pm I am all in favor of a lawsuit, especially a class action lawsuit against the crooked and morally bankrupt CRA's and while I see a clear possibility of winning for the first part, in my opinion, there is little chance for the second. That is, the crooks, pardon defendants, will lay total blame and responsibility on the doorstep the bank, First USA, for fradulant and illegaly placing the plaintiff in the position and responsility of co-holder rather than the fact of his being just an authorized user. Something the banks attempt to "get away with" any chance they have. Though their words will be to the affect "take it up with First USA we just report what information is sent to us". Thats for certain the CRA's will report any info no matter how fradulent or phony as long as their paid their fee. FCRA be damned. In any case, plaintiffs better be prepared to take this all the way to the Supreme Court because the CRA's will contest it and appeal any ruling every step of the way.
