Hello Gang!

I recently found out that the mysterious Mr. Wiley who continues to contact me is actually with World Financial Network Bank (WFNB). I believe that this is an original creditor--not an agency.

This time, my friend let me know that "...he had completed the audit (does he also work for the IRS?) on my case and will meet with his client at noon on Wednesday to formally approve the matter, and, if I want input, to call him at, etc.

OK. This dufus is not a lawyer...at least I don't think he is. How's this for size? Call his office late and let him know that on two occasions, he violated the FDCPA by stating the nature of my business on an answering machine that could be accessed bu others besides myself. I will also tell him that I have sent out a cease and desist letter to his office, and that if he calls again, I will report him to the FTC. This jerk never sent me anything in writing, so, how do I know its not some scam, right?

Jeez, I hate it when they use your first name, like they know you in person. Really irks me. Nice they can all take lunch at noon. Wish I was that lucky!!!

Youd don't need any help! You are doing just great on your own. C&D, sent and you are notifying him of the FDCPA violation for third party disclosures. You got it handled!

Thank you, Kristi. I'd love to get together with many of the Bayhouse gang to write a book about our experiences. I think that while serious, it could stand a bit of humor in it, and to tell the truth, I've had some humorous conversations with some of these collectors, especially when the supervisors come on the line (the neophytes get caught up). One example is when I was contacted for the umpteenth time at the office and informed that because California was a creditor friendly state, that I could not continue to live there without paying (so said the supervisor).

So, I asked if she was evicting me from the state, because I would have to let my office know that my commute would be longer, and would have to let family know that we were being formally evicted by Gray Davis (CA governor) because my hours were cut at work. This did not sit well with the supervisor, as racous laughter could be heard throughout the collections office (the underlings who were eavesdropping had a sense of humor, apparently). She threatened to legal the account, and I told her that "legaling" wasn't actually an action. She became frustrated and eventually hung up.

Again, thanks guys for the support. If you like, I am more than happy to report my humorous dealings with the Wolfpack. I figure you can laugh or cry at your problems, so why not do the former?

I too have had dealings with some of these collection agencies with attitudes. They are well balanced people. They have a chip on both shoulders! The guy that kept calling me said I had to send $250/month to pay on the debt. I told him I couldn't afford that. He ask what I could afford and I told him I would send $100.00/month. He told me that was unacceptable. I told him if it was not acceptable to send the uncashed check back to me when they received it. I never got a check back. After a few payments I stopped paying again because some other expense came up that rose to the top of priority list. The calls came again and this time I negociated paying it off for 40 cents on the dollar.
