Credit report indicates workman's comp claim. Can they do that.

I was going over my mother's credit report with her and her old employer MTA is showing up on the report as Insurance claim pending, unsecured. Is it legal for them to report that my mother has a claim with them. It is showing as a High Credit of $3000, terms 149. Can anyone shed any light. Thanks.

I have never seen anything like that.

Dispute with the bureaus and the reporting employer. And possibly check with a lawyer (see http://www.bayhouse.com/discus/messages/123/358.html?951596731) if your mother experienced problems due to that reporting.

For one thing, it doesn't make any sense for it to be listed like a credit account (with credit limit and repayment amount.)

Also, this could possibly be construed as *medical information*, which is prohibited from credit reports by the Fair Credit Reporting Act, unless the consumer consents.

Since it is obviously listed incorrectly, send a dispute letter to the credit bureau involved. Also request the contact information for whoever reported. Contact Worker's Compensation and see if you can get an explaination.

I can't believe they can do that.
#1: It looks like a loan with the "high credit" and "terms"

#2: I would think it would indicate that this person has limited earning power due to a disability.

#3: This is just an assumption on my part but I would guess they illegally ran the report using the "loan" as their purpose. Probobly hoping to find her in dire financial situation thus giving her a motive to file a false workmans comp claim.
(since in w/c eyes everybody is a fake)
