    Bryan | Monday, March 06, 2000 - 12:57 pm  I filed a chapter 13 in Jan 93. It was dismissed, not discharged, because I decided not to go through with it. Well I was sorely informed by my lawyer of thw entire process and thought that I could pay the debts without this chapter 13 being reported. I was wrong. in any case why is it still on my credit report? 3/1/00/ Who do i call to get it off?? |
    Anonymous | Tuesday, March 07, 2000 - 03:04 am  Dismissed or discharged, it should come off of your reports 1/2000. Contact each of the bureaus. You should have received a letter when it was dismissed stating the case #, filing date and dismissal date. Use this as proof of filing (or a copy of the first page of your filed BK papers). Just dispute it based on 7 years from the original filing date (you said Chapter 13), and it should be removed. Do this for each of the three agencies. |

Even though it was dismissed, you still filed (dismissal is usually the result of the debtor not fulfilling his obligation to make payments on time over the five year period). A dismissed 13 will remain on your credit report for the same time period as a discharged 13. Believe me - I know. |
