I have a few questions-- I have an account listed on my credit report and the date of last activity is incorrect. Actually, experian and equifax record different dates for date of last activity but both are not accurate. I do not have any old credit reports or anything proving this. Is there anything I can do? Also, when disputing information pertaining to the 7 year issue should I write the credit reporting agency or the creditor (or collection agency)? I also have a collection on my account for approx. 2400 from an agency on behalf of an apartment complex where we had a fire. The fire was probably my fault. The apartment was damaged enough that it was not fit to live in until it was remodeled, etc. The management said that since we did not have rental insurance we were liable to pay them cash for the damage. (since then I have spoken with my Allstate agent who says rental insurance would only have covered my personal belongings, not the apartment itself). Anyway, we moved out and broke the lease because we couldn't afford to pay 2 rents while the apt. was remodeled. They took our deposit and last month's rent (understandable) and then came up with the arbitrary amount of approx. 2400. They have never really been clear as to how that amount was arrived at. Anyway, there was never a judgment. First of all, is this legal for them to report this without a judgment? Also, if we negotiate and pay this, will it stay on our report just like any other credit line (this is 4 years old) for 3 more years? One more thing, I wrote to equifax 2 years ago because this is reported twice on our report (one for the apt complex, one for the collection agency) which makes it look like we owe twice the amount. Equifax replied that the duplicate was valid because it was a seriously delinquent account or something to that effect.
I know that I have a lot of questions-any help would be greatly appreciated.

What state? The statue of limitations may have run out.

I live in Florida. The statute of limitations is either 4 or 5 years here. The apartment issue was in 1996 (happened in 1/96 but they are reporting it as 6/96).
