Suit after SOL???

I have a credit card account showing a date of last activity of 7/93..no payments were made after that date.

now an attorney for the original creditor is filing suit. I have checked the links for SOL's and some say 6 years and the state of arkansas site says 5 years...

is there some other legislation in arkansas that has different SOL for credit cards?

pretty confusing!

the original card was issued in delaware, and they seem to have a texas office and the attorneys are in arkansas. so which statues apply?

any help would be appreciated.

It doesn't seem to matter whether it's 5 or 6 years, either way you're ok.

If you have the opportunity to respond to the suit, just do so. Or, send a certified letter to the attorney stating that the SOL expired and you request he withdraw the suit and pay for your time and expenses.

Or, post his name and fax # right here, along with your case # and the creditors name, and I'll contact them.

And don't just not show up in court, or you'll lose by default.
