If a old debt has already exhausted the SOL can a collection agent report it on a credit report. If so, How can he report the terms.

SOL's have nothing to do with credit report time limits. Most adverse information can be shown on your credit report for up to seven years, while in most states the SOL's are shorter.

Let me elaborate a bit more. I have an outstanding debt which was charged off by a credit card company and pick up by a collection agent. Last activity date was 11/94. I know the SOL has been exhausted but the collection agent reports it as 120 days past due. Can he do this? If not what course of action do I take. Thanks

Have the credit grantor or the collection agency document the original date of delinquency for you in writing.

If you actually were 120 days late, why do you feel they shouldn't be able to report it?

And if it was me, I wouldn't even bother calling the collection agency. I would dispute it with the credit bureau saying that the last date of activity was 11/94, but they delinquency was in '92. Therefore the delinquency shouldn't be reported. You just might get lucky.
